Hope From Santa

Hello Everyone!

On December 17th I received an email from Jaxon's current school.  They had asked all of the students in his class (and presumably others) to write letters to Santa.  Jaxon's letter was a bit different from the others, and Santa decided to write back to him.  Jaxon's letter, and Santa's response were then published in the newspaper for the area.

As mentioned elsewhere, Jaxon has difficulty with reading and writing.  This can make it difficult to read his writing if you are not familiar with it.  The transcribing/translating the newspaper did is slightly off, but they still capture the gist of what he was trying to say.

I will post a further update on the cases very soon.  I apologize that it has been so long, and will explain, but, in the meantime, I wanted to share this with you!!

PETITION FOR PATERNITY: GRANTED!

Hi everyone!

I apologize for not updating for a while, but there were multiple issues pending and I needed to wait.  Today was the Petition for Paternity hearing.  The magistrate granted my petition.  I was declared Jaxon's legal parent and his birth certificate will be changed to reflect his two parents, my ex and myself!!  This is huge.  Enormous!

I now have the exact same legal rights to my son as my ex does.  If she attempts to take or keep him from me again, she will face extreme legal/criminal consequences.

In the end, my ex dropped her contesting of my paternity petition in a negotiation.  She did not support my Petition for Paternity, but ceased to fight it.  In return, I dropped my request for a GAL, which she did not wish to pay for (the cost of a GAL is split by both parties).

The biological father opted out of all proceedings and became unreachable after having been served on all issues.  He has been found in default by the magistrate, and is no longer in the picture, legally.

A little over 2 weeks ago, my ex and I (with attorneys) met for separate-room mediation.  In that mediation we agreed to a temporary parenting schedule which includes Jaxon returning home for overnight/weekend time as well as two separate week-long periods. Other elements, including counseling/therapy for Jaxon were also stipulated.

We now move more directly into the "custody battle".  However, the "best interests of the child" will be the standard rather than "biological rights".  Yay!!!!  There is a temporary orders hearing on May 21st.  At this hearing my ex will be seeking an order to collect child support from me.  That is not the only issue that will be addressed though.  Additionally, we will likely set a date for a permanent orders hearing at that time.  I will update again after that hearing.

Thank you everyone, including my attorneys, for your continued support!  In many ways, we are just getting started, but the crazy hurdles we have overcome are mind-blowing.  I also want to specifically thank the NCLR (National Center for Lesbian Rights) and Kate Kendell - the executive director, for talking with me and responding to my situation directly. You are all amazing!!!  

I'm off to celebrate.  It was a VERY good day! ;)

Case Update

Hi!

The motion to seal the case, asking that the website also be removed, has been DENIED.  This means I will be able to continue updating you, and that there are no plans to remove this blog, or the website in general.

To recap:

Both cases (paternity and custody) have hearings in May now.  It is astounding how long these things can be dragged out and delayed, but it is what it is, and there is nothing that can be done to speed it up.

Our motion to have a GAL appointed for Jaxon is still pending.

GAL Motion Filed/ Custody Hearing Date

Hi everyone,

Paternity Case:  As of right now, the hearing set for this Friday (March 1st) is still happening.  My attorneys and I have filed a motion with the court requesting that a GAL be appointed for Jaxon in this case.  For those that don't know, GAL stands for "guardian ad litem".  It is an attorney appointed by the court to directly represent THE CHILD'S interests in a court matter, without regard to petitioner or respondent desires. We have been informed via attorneys that the bio mother will be opposing this motion.

Custody Case:  A hearing date to obtain custody orders has finally been set.  Unfortunately, opposing council states that their firm is booked through the next several months and unable to attend any court dates.  So, the hearing is not until May 21st.

Case and Benefit Update

Hi everyone,

Case Update:

We are still being delayed by opposing council in setting a hearing for the custody case, so I have no update on that right now.  The paternity hearing is still set for March 1st.  My ex and her council are attempting to delay that hearing as well, but hopefully it will happen as planned.  They also filed a motion opposing my paternity case.

Additionally, a motion has been filed to seal the case, and effectively silence me.  We are certainly going to fight this effort.  This is not my website, so it may remain up with simply this blog, the only part of the site I have access to, disappearing or changing hands if the motion to eliminate my right to speak is won.

Benefit Update:

In "unrelated" news, the benefit that Tranzcend threw this past weekend was a fabulous success.  There was so much love and support in the room.  Many people feel passionately about this issue as they have experienced the same thing themselves.  There was $1000 raised directly from the show, with the funds from gift certificate purchases not having been counted yet.  As the gift certificates are an on-going fundraiser, I will not have numbers for that for a while.

This case just keeps getting more complex.  Please donate if you can.  Come to the events people are producing and promoting.  Before you hand your card over at Eden, buy a gift certificate!  You spend the same amount, but money goes to the fund.

I am so grateful for  all of the people who have stepped up, donated what they can, and taken a stand: friends, family, and total strangers.  I feel a little like I fell down the rabbit hole with everything being upside down and sideways, but my focus has not, and will not, change.  I just need your help to get there.      

If you cannot donate, which I clearly can understand, please spread the word.  The more people that know about my son and I, the more opportunities there are for assistance.  And nobody should ever be as naive as I was - they need to know what can happen.

This upcoming Sunday, the 24th, is the benefit Sam Hozdulick is having at Eden.  Please come have brunch - with a gift certificate!

Petition for Paternity

Hello!

My attorneys and I have filed a Petition for Paternity.  This means we now have two cases pending.  There has been precedent set in Colorado, at the Supreme Court level, that paternity is not dependent on biology.  There is also a prior case setting precedent that gender is not relevant; a second female may be granted paternity.  A ruling that grants me paternity will have the same effect that the second-parent adoption would have had.  I would become Jaxon's other legal parent, and his birth certificate would be changed.   Bio-parent consent is not required.

The first hearing in the paternity case is March 1st.  We are being greatly delayed in setting a hearing date for the custody case, but expect to have one set shortly.

Benefits

Hi,

I am still waiting for legal clearance to post an update on the case.  I expect to be able to provide more information this week, but it is all rather slow moving.

I wanted to let you know about a few benefits that are happening, as well as the fundraising opportunity at Eden Bar & Cuisine Lounge in Denver.

Planned at this time:

February 16th: A variety show being held by Tranzcend  - featuring Maxx Wilson
February 24th: Brunch with Sam Hozdulick
March 29th: A burlesque show starring Kitty Crimson
April 5th: A concert being organized by Lauren Gale of Speakeasy Tiger and Brave Song Circle.

Found Bio Father

Hi,

I am able to let you know that my attorneys and I were able to locate Jaxon's presumed biological father, and serve him.  While none of the skip tracing or investigating turned up any information on him, a long phone call to the corporate offices of his previous employer did result in information.  They were able to confirm that the man named was employed in the same location, at the same time, as the biological mother.  We petitioned the court for a subpoena to issue to the corporation in request of his employment records.  It took over a month, but they did issue the subpoena.  The corporation was served and responded with his last known address.  We were not hopeful that the address would still be valid because it was 10 year old information, and he was not in a high paying job at the time.  However, the process server discovered that the home was occupied by the presumed bio father's brother, who provided the process server with the correct addresses.  He was served the court papers that night.

I am not in a position to discuss his reactions or intentions at this time, but I have spoken to him, and his wife, directly.

Having found and served the presumed bio father meets the courts requirements necessary to be heard.  We will be setting a new temporary orders custody hearing in the next week or two.  Everything moves slowly.  It took 3 months to get to where we are now.  Things that seem like they should take five minutes take 2 weeks to get through the system.
